Booking Terms and Conditions

 

Except where otherwise specified, we Tuscany Now Limited - registered office: Lynton House, 7-12 Tavistock Square, London, WC1H 9BQ ("we" or "us") - act only as an agent in respect of all bookings we take and/or make on your behalf. We accept no liability in relation to any contract you enter into or for any services or arrangements you purchase ("arrangements") or for the acts or omissions of any supplier(s) or other person(s) or party(ies) connected with any arrangements.

 

For all arrangements, your contract will be with the supplier of the arrangements in question (the "Property Owner"). When making your booking we will arrange for you to enter into a contract with the applicable Property Owner of the arrangements. Your booking with us is subject to these Agency Terms and Conditions and the specific booking conditions of the relevant Property Owner(s) you contract with and you are advised to read both carefully prior to booking. The Property Owner's terms and conditions may limit and/or exclude the Property Owner's liability to you. Copies of applicable conditions are available on request from us.

 

You may decide to make one or more bookings with us at the same time. Whatever you decide, we will treat each element as a separate booking so that the price charged in total for the booking of more than one element will always equal the prices charged separately for each individual element. To help you to identify which element you would like to book, prices on our website are listed by element and each element of the booking is available to buy separately at the same price as it would be if more than one element is booked. This means that any multiple bookings do not constitute a package as defined in the Package Travel, Package Holidays and Package Tours Regulations 1992.

 

By making a booking with us, you agree that:

 

a.             you have read the terms and conditions set out below and agree to be bound by them;

b.             you consent to our use of your information in accordance with our Privacy Policy; and

c.             you are over 18 years of age and where placing an order for services with age restrictions you declare that you and all members of your party are of the appropriate age to purchase those services.

 

1.              THE BOOKING FORM

 

When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party these booking conditions. In order to confirm your chosen arrangements, you must pay a deposit as required by the Property Owner of the arrangements in question. You must also pay all applicable insurance premiums and booking fees. Your booking is confirmed and a contract between you and the Property Owner will exist when we send you confirmation on their behalf.

 

Please check your confirmation carefully and report any incorrect or incomplete information to us immediately. Please ensure that names are exactly as stated in the relevant passport. As we act only as booking agent, we have no responsibility for any errors in any documentation except where an error is made by us.

 

If you have paid a deposit, you must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, we will notify the Property Owner who may cancel your booking and charge the cancellation fees set out in their booking conditions.

 

Except where otherwise advised or stated in the booking conditions of the Property Owner concerned, all monies you pay to us for arrangements will be held on behalf of the Property Owner(s) concerned.

 

2.              THE PARTY LEADER

 

The Party Leader is the person in whose name the booking is made and to whom all correspondence and invoices are addressed and as such is responsible for the rental. Spouses' names are not considered interchangeable. The term clients shall refer to members of the party and in this context does not solely refer to the Party Leader.

 

3.              PRICE

 

The price quoted on the rental Invoice is the contractual rental price. This will be referred to as the Invoice Price. This is the price payable by the Party Leader for the rental of the arrangements. The rental price will be confirmed at the time of booking and will be guaranteed by the Property Owner once the deposit has been paid in accordance with their payment schedule as indicated below. All local taxes, if applicable, are not included in the Invoice Price and are to be paid locally.

 

We reserve the right to amend advertised prices at any time.  We also reserve the right to correct errors in both advertised and confirmed prices. Special note: changes and errors sometimes occur.  You must check the price of your chosen arrangements at the time of booking.

 

4.              PAYMENT

 

If you have paid a deposit, you must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, we will notify the Property Owner who may cancel your booking and charge the cancellation fees set out in their booking conditions. In this event we will also charge you an administration fee of £50. Except where otherwise advised or stated in the booking conditions of the Property Owner concerned, all monies you pay to us for arrangements will be held on behalf of the supplier(s) concerned.

 

Please Note: The Property Owner's typically apply the following payment terms to accommodation bookings:

 

  • If the initial reservation is received less than nine weeks (63 days or less) before the first day of the rental period, the completed Booking Form must be accompanied by 100% of the total Invoice Price within two days.
  • If the initial reservation is received more than nine weeks (64 days or more) before the first day of the rental period, the completed Booking Form must be accompanied by a deposit of 30% of the total Invoice Price within four days.
  • If the booking is being made for the following year and the initial reservation is received prior to 15th November and more than nine weeks (64 days or more) before the first day of the rental period, the completed Booking Form must be accompanied by a deposit of 10% of the total Invoice Price within four working days. A further 20% of the total Invoice Price is due by the 15th December of the year before the booking.
  • Full payment is due within nine weeks (63 days) of the first day of the rental period. If payments are not received on time we reserve the right to notify the Property Owner without prior notice who may cancel the booking outright and apply cancellation charges.

 

The above information is provided as guidance only on behalf of the Property Owners. We will advise you prior to booking if a Property Owner stipulates that different payment terms are to apply to any particular booking.

 

5.              METHODS OF PAYMENT

 

Invoices are issued and payments are accepted in Sterling (£) only. Payments may be made by credit or debit card. We accept Visa, Visa Delta, MasterCard and American Express credit cards. We do not accept cash, Diners' Club cards, cheque, bank drafts or wire transfers. The Final Bill, for extra services and utilities which will be presented by the Property Owner or their caretaker of the property at the end of the rental period, must be paid directly to him/her in Euros (€).

 

6.              LETTING PERIOD

 

The letting period applied by the Property Owners for all properties is for a minimum of one week, running from Saturday to Saturday. Exceptions to this letting structure may be considered by a Property Owner for bookings made for rentals out of season.

 

7.              GROUP SIZE AND COMPOSITION

 

The Property Owners' insist that the number of people staying at the villa throughout the rental period must never exceed the number of sleeping places indicated in the property description and confirmed in the accommodation voucher.

 

Exceptions to this condition are made by Property Owners only for children under the age of 2 years old; provided they are sleeping in a crib or cot and not occupying one of the Villas beds. However, prior notification of the number of such children is required at the time of booking. Certain Villas have individual restrictions on the number of children at the property and this includes children under 2.

 

Should the composition of the party as detailed in the booking form change prior to the rental period, clients must notify us promptly in writing. We will then advise the Property Owner who may in turn apply additional charges as a result. At certain times of the year some of the Property Owners offer a discounted rate for smaller parties. Should a booking be made on this basis it can be changed at any time to accommodate a larger group up to the maximum number of people allowed at that property. However, in these cases the Property Owner will apply an additional charge according to the revised numbers. A reduction in the numbers of the party with a corresponding reduction in the rental price is not permitted by the Property Owners once the booking has been confirmed.

 

8.              AMENDMENTS OR CANCELLATIONS BY YOU          

Any cancellation or amendment request must be sent to us in writing, by email or post, and will take effect on the day we receive it. Proof of posting is not proof of receipt, therefore you are advised to also confirm all changes to us by telephone. Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will try to assist, we cannot guarantee that such requests will be met. Amendments and cancellations can only be accepted in accordance with the terms and conditions of the Property Owner of your arrangements. The Property Owner may charge the cancellation or amendment charges shown in their booking conditions (which may be as much as 100% of the cost of the travel arrangements and will normally increase closer to the date of departure). In addition you must pay us an administration fee of £50 per person for any amendments to bookings.

 

9.              AMENDMENTS OR CANCELLATIONS BY THE PROPERTY OWNER

 

We will inform you as soon as reasonably possible if the Property Owner needs to make a significant change to your confirmed arrangements or to cancel them. We will also liaise between you and the Property Owner in relation to any alternative arrangements offered by the Property Owner but we will have no further liability to you.

 

10.           OUR RESPONSIBILITY FOR YOUR BOOKING

 

Your contract is with the Property Owner and its booking conditions apply. As agent, we accept no responsibility for the actual provision of the arrangements. Our responsibilities are limited to making the booking in accordance with your instructions. We accept no responsibility for any information about the arrangements that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of the commission we earn on your booking (or the appropriate proportion of this if not everyone on the booking is affected). We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment.

 

11.           VISA PASSPORT AND HEALTH REQUIREMENTS

 

Unless you tell us otherwise, we are entitled to assume that all members of your party are British citizens who hold or will hold full British passports valid for the entire duration of the arrangements you chose to purchase. Information on visa, passport and health requirements, where given and applicable, is so given on this basis. Requirements may change and you are therefore strongly recommended to check the up to date position with the supplier of the arrangements, Passport Office, appropriate embassy or consulate or your doctor as applicable in good time before departure.

 

12.           COMPLAINTS

 

Because the contract for your arrangements is between you and the Property Owner, any queries or concerns should be addressed to them. If you have a problem whilst on holiday, this must be reported to the Property Owner or their caretaker immediately. If you fail to follow this procedure there will be less opportunity for the Property Owner to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result.

 

Please note: we can provide 24-hour assistance with emergencies, in our capacity as agent – i.e. by way of assisting you in liaising with the Property Owner to resolve any problem that you are experiencing. If you require such assistance, please contact us on the number provided.

 

If you wish to complain when you return home, write to the Property Owner. You will see their name and contact details in any confirmation documents we send you.

 

13.           ACCOMMODATION RATINGS AND STANDARDS

 

All ratings are as provided by the relevant Property Owner. These are intended to give a guide to the services and facilities you should expect from your accommodation. Standards and ratings may vary between countries, as well as between suppliers. We cannot guarantee the accuracy of any ratings given.

 

Panoramic views and privacy entail a certain amount of elevation and distance from main thoroughfares so please be prepared for a hill or two along the way. Access roads to rural properties may be rough, twisting and/or bumpy - drivers of low-slung cars should check with us to ensure that access is reasonable. Stated driving times are approximate. It should be noted that the information contained in any printed material is to be considered only as an indication.

 

14.           DOCUMENTATION & INFORMATION  

 

All descriptions and content on our website or otherwise issued by us is done so on behalf of the Property Owner(s) in question and are intended to present a general idea of the services provided by the Property Owner(s) in question. Not all details of the relevant services can be included on our website. All services shown are subject to availability. If you require any further details, in respect of any accommodation or any other services please contact us.

 

15.           ACCURACY OF PRICES AND BROCHURE DETAILS

 

Important note: the information and prices shown in our brochure or on our website may have changed by the time you come to book your arrangements. Although we make every effort to ensure the accuracy of our brochure / website information and prices at the time of printing, regrettably errors do occasionally occur.  You must therefore ensure you check the price and all other details of your chosen arrangements with us at the time of booking. 

 

16.           CONCIERGE SERVICES

 

Some of the Property Owners are able to provide Extra Services as part of your arrangements. The Extra Services available at each property are displayed on our website under the price and availability tab, simply go to this section and click on "Extra services available payable locally". Extra Services may be requested up to twenty one days before the first day of the rental period, we cannot guarantee Extra Services requested as these are provided by the Property Owner.

The following extra services are typically offered by the Property Owners:     


Maid service. The maid service included with the property rentals involves cleaning and tidying only. It should be noted that this service does not cover the making of the beds, cleaning of the kitchen, laundry or ironing. Extra maid service prices vary, depending on the Property Owner and their location.        

Cook Service. Cooking services vary and are charged either on an hourly basis or on a per-person basis, please check on the website at the individual property for details.       

Shopping. If you send us a shopping list in advance, before the deadline for booking Extra Services, we can pass this on to the Property Owner and arrange for this to be provided to you. In addition to the cost of the items themselves, there may be a charge for the shopping service, refer to our website for a price guideline. Whilst we do our utmost to ensure the accuracy of the list, this service is prone to errors - often in the most amusing ways - due to misinterpretations and substitution of local products for those requested. Prices indicated on the website serve as a guideline only and are subject to change. The actual cost should be confirmed with the Property Owner / caretaker of the property.      

 

17.           CANCELLATION OF EXTRA SERVICES

 

The Property Owners allow for Extra Services to be cancelled without penalty until twenty one (21) days prior to the first day of the rental period, provided notice of cancellation is received in writing, please provide such notice to us in the first instance, and we will then advise the Property Owner accordingly. Notice of cancellation of Extra Services received within twenty one (21) days of the rental period may be subject to cancellation charges applied by the Property Owner.

 

18.           TRAVEL ARRANGEMENTS AND TOURS

 

You are responsible for ensuring that you hold the proper documentation for your visit to Italy. Travel arrangements, airport transfers, car rentals and extension packages as experiences for our clients are provided by "Italian Journeys" or by "The art of Leisure". By submitting your enquiry, you are simply indicating your interest in these services and asking us to convey your enquiry to the appropriate supplier. Any subsequent agreement/s made with "Italian Journeys" or by "The art of Leisure" is subject to their terms and conditions.

 

19.           ACCOMMODATION VOUCHERS

 

The Accommodation Voucher package, which includes confirmation of extra services requested, driving directions, contact names and telephone numbers, will be provided by us, on behalf of the Property Owner, once the fully completed booking form and the total Invoice price have been received and no later than three weeks before the first day of the rental period. The Voucher will not be issued if essential information, including group composition, is missing in the booking form. Errors or omissions in the accommodation voucher must be noted and notified to us immediately, so that we may in turn advise the Property Owner. The accommodation voucher must be presented and left with the individual greeting you at the property or access may be denied. The Voucher package also contains the Final Bill which is to be completed and left with the Property Owner / caretaker at the conclusion of the rental period.

 

20.           ARRIVALS

 

The Property Owner's expect you to arrive at the property between 4:00 pm and 7:00pm on the first day of the rental period. If a different arrival time is anticipated, notification must be received in writing at our offices well in advance, so that we can inform the Property Owner and they can ensure that either themselves or the caretaker is available to permit entry. If an unforeseen delay should occur, every effort should be made to contact the Property Owner (or their caretaker) at the telephone number provided in the Accommodation Voucher. Arrivals after 7:00pm may be subjected to a surcharge. Access cannot be guaranteed after 10:00pm. Upon arrival, the Party Leader should inspect the property with the Property Owner / caretaker and ensure that they fully understand the use of any appliances, equipment and utilities. Additionally, the electricity meter will be checked and the reading recorded.

 

21.           DEPARTURES

 

The Property Owner's insist that the property should be vacated by 10:00am on the final day of the rental period. The Property Owner / caretaker will arrive at the villa at 9:00am for an inspection of the property and for presentation and payment of the Final Bill. It must be understood that to enable the property to be cleaned and made ready for the next group that cleaners may need to commence their work at 8 am. Should departure prior to that be necessary, please notify the Property Owner / caretaker at the beginning of the rental period in order to arrange an alternative time for the property inspection. If you choose not to be present at the inspection, The Property Owner will not entitle you to query the Final Bill, and you will be invoiced for the amount indicated plus a £75.00 administration fee.

 

22.           CLEANING AND MAINTENANCE

 

The Property Owner's will ensure that your villa will be cleaned prior to your arrival and that the pool will also be cleaned and serviced. Some properties will have additional cleaning and a pool maintenance schedule for the week. Certain properties have gardens that require the presence of a gardener. All this is for your greater enjoyment of the property. Whilst every effort is made by the Property Owners to respect your privacy for your exclusive stay, access for these services must be allowed. In respect of unforeseen events that require the presence of a specialized repair engineer access must similarly be granted.

 

23.           HOUSEHOLD AMENITIES

 

Rental properties with no licence are private homes therefore the Property Owner is not permitted to supply bed linens, bathroom and swimming pool towels. Therefore, in our capacity as agent, we shall arrange for these items to be provided on behalf of the Property Owner and they are payable locally upon arrival in Euros (cash). Rental properties with a licence are permitted to arrange and supply on your behalf bed linens, bathroom and swimming pool towels sufficient for the number of guests indicated in the Booking Form, note that these shall be provided weekly. For further details please refer to the Price and Availability page of your chosen villa rental option.

 

Utilities - Charges for heating are applied by the Property Owner according to consumption and must be paid locally at the end of the rental period. It should be noted that in some municipalities the use of central heating is prohibited between May and September. The Property Owner or caretaker will advise if a problem regarding its use, during this period, exists. 330 kilowatts of electricity are included by the Property Owner in the rental charge (Unless stated differently in the specific price section of the villa). From 2015 excess consumption is charged at €0.80 per kilowatt. Water and tap hot water are included by the Property Owner in the rental charge. Should problems arise with the delivery of water, gas, electricity or telephone services, the Property Owner / caretaker of the property will do their utmost to remedy the situation but we, in our capacity as agent, cannot accept responsibility for non-delivery. Hot tubs - A charge is generally applied by Property Owners for the heating of hot tubs, where available.

 

24.           SWIMMING POOLS

 

Swimming pools are generally open between May 15th and September 30th, although this may vary according to the weather and the Property Owner's inclinations. You should check this position with our sales agents. Use of the swimming pool is strictly at your own risk and children should be supervised at all times. In the event that you require use of the swimming pool outside the period of mid May until the end of September (when all pools are open) we can pass on your request to the Property Owner. The final decision will be down to the Property Owner at their discretion; an extra charge may apply. Swimming pools are cleaned and serviced regularly; each property has its own schedule. Whilst every effort is made to keep the pool clean we, in our capacity as agent, do not accept any liability for leaves, insects etc that may fall into the water between the scheduled cleaning. In respect of the properties with heated pools extra charges may be applied by the Property Owner should heating be by a non solar panel source. Pools heated by solar panels only may not reach an ambient temperature. The panels do require sufficient sunlight for them to work efficiently.

 

25.           ANIMALS

 

The majority of the properties which we advertise lie within farming or rural areas and livestock or wildlife is frequently present. Neighbouring properties may have dogs that bark and sound travels in the countryside. The Property Owner will make every effort to ensure your quiet enjoyment of your selected villa but we, in our role as agent, take no responsibility for any such disturbances. Pets are not accepted by the Property Owner at any property, unless noted in the description. Where accepted, pets are restricted to a single non-aggressive dog and the Property Owner's permission must be obtained in writing before the booking can be confirmed.

 

26.           WEATHER

 

During unusually dry periods water shortages may occur in rural locations with the result that lawns may become scorched and wells may malfunction slightly. Likewise, sudden rains can seriously affect roads, drives and stated driving times. Many of the properties which we advertise use septic tanks and changing weather conditions can occasionally produce odd smells.

 

27.           USAGE

 

The Property Owner will ensure that the property will be in a clean and well-maintained state when you arrive, and it is expected that you and your party will keep it so throughout the rental period. If the property has not been left in an acceptable state, the Property Owner / caretaker at his/her discretion may charge an additional amount to the Final Bill for the extra cleaning and tidying required. If this cost is not paid in the final bill locally and a charge has to be raised by us to cover such costs then we reserve the right to charge £75 to cover administration expenses.

 

The Party Leader is responsible for the reasonable behaviour of their party. Should the party behave in a manner that is not acceptable, the Property Owner / caretaker has the right to ask you to vacate the premises. House parties, weddings or any business use are not permitted by Property Owners unless previously arranged and confirmed in writing by the relevant Property Owner.

 

28.           THE FINAL BILL

 

The Final Bill includes lists of the specific costs of Extra Services booked in advance which are to be paid, to the Property Owner, locally. On our web site we list charges as a guide only and variations may occur depending on prevailing conditions. Extra services booked on the spot will also be charged locally by the Property Owner. In addition, charges for electricity in excess of the allowance, telephone and central heating charges will be calculated and are payable locally. The Final Bill is presented by the Property Owner / caretaker at the conclusion of the rental period and is payable to him/her in Euros (cash). Both the Party Leader and the Property Owner / caretaker are required to sign the Final Bill.

 

The Party Leader is liable to the Property Owner for any damages caused to the property, its contents or grounds by any member of the party or the loss of any articles belonging to the property such as mobile telephones. Charges for breakages or repairs caused by the party staying at the villa will be noted by the Property Owner during the final inspection. Charges that can be calculated on the spot will be added to the final bill. However, the charges that cannot be quantified immediately will be calculated and billed to Party Leader by the Property Owner at a later date. These charges include (but are not restricted to) utilities for which the property is billed on a monthly or bi-monthly basis and damages or lost articles for which the repair/replacement estimates are not available. Under extreme circumstances, the amount shown on the Final Bill may be invoiced and paid through us, in our capacity as agent, on the understanding that a £75.00 administration fee will be added to the amount due. The amount of the final bill in Euros(€) will be invoiced in Sterling (£) at the rate given by the Financial Times of London on the Monday following departure.

 

29.           TRAVEL INSURANCE

 

You are strongly recommended to take out personal travel insurance for all members of your party. Some suppliers require that you do so. It is your responsibility to ensure that the insurance you purchase is adequate and appropriate for your particular needs. Please read your policy details on receipt and take them with you on holiday.

 

30.           LAW AND JURISDICTION

 

These terms of business are governed by English law and the courts of England and Wales have jurisdiction (unless you live in Scotland or Northern Ireland, in which case you can bring proceedings in your local court under Scots or Northern Irish law, as applicable).
